Even if the government employee kills the husband, the wife will get family pension. The observation was made by the Punjab and Haryana High Court in India in a case hearing. Not only the observation, but also the order issued by the Haryana government in this regard has been rejected and the convicted woman has been directed to pay her due family pension and other dues within two months.
Even if a wife kills her husband, she cannot be deprived of family pension. The court further said, "Family pension is a welfare scheme. The project was started to provide financial assistance to the family of a government employee in case of his death. Therefore, if a wife is convicted in a case under the Indian Penal Code, she is still obliged to receive a family pension.
The woman's name is Baljit Kaur, a resident of Ambala in Haryana. One of his petitions was being heard in the Punjab and Haryana High Court. Baljit's lawyer said her husband, Tarsem Singh, a government employee, died in 2008. Then in 2009 a murder case was filed against him. In 2011, Baljit was convicted in that case. Until he was convicted, he was receiving family pension money from the Haryana government.
But the Haryana government stopped it in 2011. Baljit appealed to the Haryana government to quash the order. A bench of the Punjab and Haryana High Court dismissed the Haryana government's order. The court also directed Baljit to pay his arrears of family pension and other dues within the next two months.
